Terms of Service

These Terms of Service ("Terms") govern your access to and use of Sunburst, an AI website builder operated by Coal Creek AI, Inc. ("Sunburst", "we", "our", "us"). They form a legal agreement between Sunburst and the person or entity using the service ("you" or "Customer").

By creating an account, accessing sunburst.ai, or using the Sunburst service in any other way, you agree to these Terms. If you are using Sunburst on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use Sunburst.

To use Sunburst you must be at least 18 years old, or the age of majority in your jurisdiction if higher, or be using the service on behalf of an organization that is itself eligible.

Each Sunburst account supports one active editor at a time. You are responsible for the security of your credentials and for all activity that takes place under your account. Notify us promptly if you believe your account has been accessed without your authorization.

You agree not to: (a) use Sunburst to publish content that is illegal, infringing, defamatory, harassing, or abusive; (b) use Sunburst to send spam or distribute malware; (c) attempt to reverse engineer, decompile, or extract the source code of Sunburst, except to the extent applicable law expressly permits; (d) interfere with, overload, or attempt to gain unauthorized access to the service, including by bypassing rate limits or technical restrictions; or (e) resell, sublicense, or otherwise commercially redistribute the Sunburst service except as expressly permitted in writing by us.

We may suspend or restrict access to the service if we reasonably believe it is being used in a way that violates these Terms or creates a risk of harm to Sunburst or others. Where practical and lawful, we will give notice and an opportunity to cure before suspending.

You retain all rights in the text, images, brand assets, and other materials you upload to or create on Sunburst ("Customer Content"). You grant Sunburst a worldwide, non-exclusive license to host, copy, transmit, display, and process Customer Content as needed to provide the service to you, including processing that content through AI models that generate, refine, or analyze your site. This license ends when the relevant Customer Content is deleted from Sunburst, except to the extent we are required to retain it, for example in backups that expire on a normal cycle.

Sunburst, including the Sunburst name, logo, software, design system, templates, and all related intellectual property, is owned by Coal Creek AI, Inc. and its licensors. These Terms do not grant you any right to use the Sunburst brand outside of your normal use of the service.

Sites you generate or edit on Sunburst, including the HTML, CSS, copy, and design choices produced through your use of the Design Agent or Website Editor, are yours to publish, modify, and continue to use under these Terms. AI-generated output is provided as-is, and you are responsible for reviewing it and confirming it suits your purposes before publishing.

If you send us suggestions or feedback about Sunburst, you grant us a perpetual, royalty-free, worldwide license to use that feedback for any purpose without obligation to you.

If you believe content on Sunburst infringes your copyright, you can send a notice under the U.S. Digital Millennium Copyright Act ("DMCA") to our designated agent at copyright@sunburst.ai. Your notice must include: (a) a physical or electronic signature of the person authorized to act on behalf of the copyright owner; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and information sufficient to locate it; (d) your contact information, including address, phone number, and email; (e) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner.

When we receive a complete notice, we will remove or disable access to the material in question and notify the user who posted it. That user may submit a counter-notice if they believe the removal was a mistake or misidentification.

We will terminate the accounts of users who are repeat infringers in appropriate circumstances. We may also terminate accounts based on a single instance of clear infringement.

Pricing for Sunburst plans is described on sunburst.ai. Paid plans renew automatically at the end of each billing cycle for the same term and at the then-current price, charged to the payment method on file, until you cancel.

You can cancel a paid plan at any time from your account settings. Cancellation takes effect at the end of your current billing cycle, and you keep access through that date. Sunburst does not provide refunds for partial billing cycles unless required by law.

You are responsible for any taxes that apply to your subscription, other than taxes on Sunburst's income.

If a charge fails, we may suspend access to paid features until payment is resolved. We will give reasonable notice before doing so.

You may close your Sunburst account at any time. When you do, your published sites will go offline and your Customer Content will be deleted in accordance with our Privacy Policy. Where supported, you can export your content before closing your account.

We may suspend or terminate your account, with or without notice, if you materially breach these Terms, if your use of Sunburst creates a risk of legal or reputational harm to Sunburst or its other customers, or if we are required to do so by law.

Sections of these Terms that by their nature should survive termination, including those relating to intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will survive.

Sunburst is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising out of any course of dealing or usage of trade.

AI-generated output, including text, design choices, and structured data, is produced by models that can return inaccurate or unsuitable results. Sunburst does not guarantee that AI output will be accurate, lawful, or fit for your specific purpose, and AI output is not legal, financial, medical, or other professional advice. You are responsible for reviewing AI output before relying on or publishing it.

To the fullest extent permitted by law, Sunburst's total aggregate liability arising out of or relating to these Terms or your use of the service will not exceed the greater of (a) the fees you paid to Sunburst in the twelve months immediately preceding the event giving rise to liability, or (b) one hundred U.S. dollars. In no event will Sunburst be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, or goodwill, even if advised of the possibility of such damages.

You agree to defend and indemnify Sunburst against third-party claims arising out of Customer Content you publish through Sunburst or out of your breach of these Terms.

We may update these Terms from time to time. When we do, we will post the updated Terms on sunburst.ai and update the "Last updated" date at the top of this page. If the changes are material, we will give you reasonable advance notice, for example by email to the address associated with your account.

Continued use of Sunburst after updated Terms take effect means you accept the updated Terms. If you do not agree to a material update, you should stop using Sunburst before the update takes effect.
